Terms of Service

These Terms of Service govern all services provided by Weird Business Consulting (WBC), owned and operated by Kayla Gagnier, based in Idaho. By purchasing or using any WBC service, you agree to these terms.

1. Services Offered

WBC provides the following services to small businesses:

Specific deliverables, timelines, and scope for each engagement are detailed in your individual service agreement, which is provided at onboarding and stored in your shared Google Drive folder.

All fees are due as follows:

WBC may pause or suspend services if payment is not received. There are no refunds for months already billed and delivered.

To keep your project on schedule, clients are responsible for supplying:

Work timelines begin once client-provided content has been delivered. Delays in content delivery may push the project timeline accordingly.

5. Ownership & Files

Your website files belong to you. WBC builds on static HTML — no proprietary CMS, no platform lock-in. You can take your files anywhere.

WBC retains ownership of its internal tools, automation systems, frameworks, and workflows developed independently of your project. The Holler system is a WBC product — client use is licensed, not owned.

6. Hosting & Security

Websites are deployed on Netlify's free hosting tier. WBC is not responsible for Netlify outages, service changes, or downtime beyond our control. Sites can be redeployed within hours if needed.

WBC builds static HTML sites — there is no database, no login panel, and no server-side code. This significantly reduces security risk compared to CMS platforms. WBC is not responsible for issues originating from your domain registrar, existing hosting, or third-party integrations you manage independently.

Either party may cancel services with 30 days written notice sent to weirdbusinessconsulting@gmail.com.

8. Third-Party Platforms

Some services involve third-party platforms such as Facebook, Instagram, TikTok, FareHarbor, or Stripe. WBC is not responsible for changes to platform APIs, policies, terms, or availability. We will make reasonable efforts to adapt to platform changes, but cannot guarantee uninterrupted service when platforms change their rules.

9. Limitation of Liability

WBC's total liability for any claim arising from our services is limited to the amount you paid in the 30 days prior to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost revenue, lost data, or business interruption.

10. Governing Law

These terms are governed by the laws of the State of Idaho, USA. Any disputes will be handled in Kootenai County, Idaho.

11. Updates to These Terms

WBC may update these terms from time to time. When we do, the "Last Updated" date at the top of this page will change. Continued use of our services after an update constitutes acceptance of the revised terms. If a change is significant, we'll let active clients know directly.
